These Terms and Conditions tell you the rights and obligations you have. Please read these carefully. Your statutory rights are not affected. The construction, validity and performance of any contract and of these Terms and Conditions shall be governed by the Law of England. MKM Extrusions Ltd on-line Terms and Conditions of purchase apply for use on MKM Extrusions Web site/s. It is the responsibility of the purchaser to verify the correct email address of the recipient. To purchase on-line from us you must be over 18 and resident in the United Kingdom. Currently we only ship on-line orders to locations within the United Kingdom, and English is the only language available on this website. Please contact us if you are outside of the UK. By submitting your order you are offering to buy the goods and allowing us to use your personal details for the purposes of supplying goods (including passing your details onto couriers and other subcontractors). We will not use your details for other purposes without asking your consent and you may ask that your details are removed from our system by writing to the address above. We are not obliged to supply the goods to you until we have confirmed acceptance of your order and this is when the contract is made. The email you receive immediately after placing your order is only an automated summary of your order and does not constitute acceptance by MKM Extrusions Limited of your offer to purchase. We will send you a further email to inform you when your order has been confirmed. You do not own the goods until we receive payment in full. If you discover you have made a mistake or would like to amend your order please contact Customer Services. Please do this before we confirm your order. All prices and offers are subject to change and availability. Errors and omissions excepted. Subject to not selling below our cost price. VAT will be charged additionally on all prices (including carriage) at a rate of 20%.
Please contact a qualified supplier for advice on using adhesives & fixing materials when using our products. The materials we use in production of our products are specified in Useful links under Data Sheets.
We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.
We aim to deliver goods to you within the time indicated by us but we cannot give an exact delivery date. We also may deliver the goods in several consignments but will not charge any extra delivery for this. If we have not delivered the goods within 10 days of expected delivery then you may cancel the contract. We will supply goods that are free from defects in materials and workmanship for a period of 12 months (or longer if required by law) from the date of delivery. Goods suitable for external use are described as 'External Grade.' All other goods are intended for internal use. None of the materials are suitable for contact with foodstuffs. Our specifications shall be subject to reasonable commercial variation.
You should inspect the goods when you receive them for defects or damage. If you find a defect or damage you must tell us as soon as possible and we will arrange for their return to us at no cost to you. If the goods are found to be damaged or defective prior to delivery to you, we will at our option replace the goods or refund the price paid by you.
If you are a business or if the goods are used wholly or in part for business purposes we shall not be liable to you for any business loss including loss of profits (whether direct or indirect) revenue, goodwill, or incidental, or consequential loss that you may suffer as a result of the purchase of goods from us. Any other liability shall be limited to the price paid for the goods. We do not exclude our liability for fraud or for death or personal injury. For our performance time is not of the essence.
You have the right, in addition to your other rights, to cancel this contract for no reason at all and without penalty. To cancel this contract you must give us notice within 14 days starting on the day after the day you receive the goods from us. If you wish to cancel this contract, please write to ‘Returns’, MKM Extrusions, Fowey Cross, Lostwithiel, Cornwall, PL22 0JG. Alternatively, you can fax us on 01208 873545 or email email@example.com We will then issue you with a Return Authorisation Number, which will allow us to trace your return.
You can return the goods to us at your cost to the returns address below. We also advise you to make sure the goods are adequately packaged for their return journey, as the goods must be received in a complete and resaleable condition. We can collect the goods from you at your cost. Subject to the above we shall refund the total amount of money paid by you for this contract, less any charges to collect the goods (if required) within 14 days starting with the day on which we receive a notice of cancellation in writing from you.
